1. Geltungsbereich
Diese AGB gelten für die Nutzung der App "FlowStart" von Christian Schulze.
2. Vertragsgegenstand
FlowStart ist eine App für tägliche kreative Aufgaben. Die Nutzung setzt ein kostenpflichtiges Abonnement voraus (Abschnitte 4 und 5).
3. Registrierung
Für die Nutzung ist eine Registrierung erforderlich. Du musst mindestens 16 Jahre alt sein.
4. Leistungsumfang
4.1 Das Abonnement umfasst:
- Bis zu 3 Kategorien gleichzeitig
- Alle Kategorien und Schwierigkeitsgrade
- Den Garten mit allen Pflanzen und Deko
- Das Neu-Würfeln von bis zu 3 Aufgaben pro Kalendermonat
- 2 Streak-Freezes pro Kalendermonat
Die App enthält keine Werbung.
4.2 Konten, die vor Einführung des Abonnements angelegt wurden, können FlowStart weiter im damaligen kostenlosen Umfang nutzen (1 Kategorie, Schwierigkeitsgrad Anfänger).
5. Abonnement, Testzeitraum und Zahlung
5.1 Das Abonnement ist als Monats- oder Jahresabo erhältlich, jeweils auch als günstigerer Bildungstarif für Schüler, Studierende und Autodidakten. Den Bildungstarif wählst du selbst, ein Nachweis ist nicht erforderlich.
5.2 Das Jahresabo kann mit einem kostenlosen Testzeitraum von 7 Tagen beginnen. Ob der Testzeitraum angeboten wird, entscheidet der jeweilige Store, in der Regel nur, wenn du über dein Store-Konto noch kein FlowStart-Abo hattest. Kündigst du vor Ende des Testzeitraums, zahlst du nichts. Andernfalls geht er automatisch in das kostenpflichtige Jahresabo über.
5.3 Die Zahlung erfolgt über den Apple App Store oder Google Play Store.
5.4 Das Abo verlängert sich automatisch, wenn es nicht mindestens 24 Stunden vor Ablauf gekündigt wird.
5.5 Die Kündigung erfolgt über die Abo-Einstellungen des jeweiligen App Stores. Du erreichst diese direkt aus der App unter Profil > Abo verwalten / Kündigen.
5.6 Vertragspartner des Kaufs ist der jeweilige Store (Apple bzw. Google), nicht wir. Die Zahlungsabwicklung, Rechnungsstellung und Erstattungen laufen ausschließlich über den Store. Ein etwaiges Widerrufsrecht sowie Erstattungsanträge richten sich daher nach den Bedingungen des jeweiligen Stores und sind dort geltend zu machen:
5.7 Endet das Abonnement, kannst du die Aufgaben nicht mehr nutzen, bis du es erneut abschließt. Dein Konto, dein Fortschritt und dein Garten bleiben erhalten.
6. Nutzungsrechte und Teilen
6.1 Mit dem Download erhältst du ein einfaches, nicht übertragbares Recht, die App für dich persönlich zu nutzen.
6.2 Aufgaben, Texte, Zeichnungen und Design der App sind urheberrechtlich geschützt.
6.3 Teilen ist ausdrücklich erwünscht. Du darfst Screenshots, einzelne Aufgaben und alles, was du dazu gestaltest, privat und in sozialen Medien zeigen, gern mit Hinweis auf FlowStart. Was du selbst erschaffst, gehört dir.
6.4 Nicht erlaubt ist, Aufgaben in großem Umfang zu sammeln und weiterzuverbreiten oder kommerziell zu nutzen, zum Beispiel als eigene Aufgabensammlung, App oder Kurs.
7. Verfügbarkeit
Wir bemühen uns um eine hohe Verfügbarkeit, können diese aber nicht garantieren. Wartungsarbeiten werden nach Möglichkeit angekündigt.
8. Haftung
8.1 Wir haften unbeschränkt für Vorsatz und grobe Fahrlässigkeit.
8.2 Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten.
8.3 Die Haftung für Datenverlust ist auf den typischen Wiederherstellungsaufwand beschränkt.
9. Kündigung
Du kannst dein Konto jederzeit in der App unter Profil > Konto löschen entfernen. Ohne installierte App kannst du die Löschung unter https://flowstart.app/delete-account.html beantragen. Das Abonnement muss separat über den jeweiligen Store gekündigt werden (siehe 5.5).
10. Änderungen der AGB
Wir behalten uns vor, diese AGB zu ändern. Über wesentliche Änderungen informieren wir dich per E-Mail oder in der App.
11. Schlussbestimmungen
11.1 Es gilt deutsches Recht.
11.2 Gerichtsstand ist Dierdorf, soweit gesetzlich zulässig.
11.3 Sollten einzelne Bestimmungen unwirksam sein, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt.

1. Scope
These Terms of Service apply to the use of the app "FlowStart" by Christian Schulze.
2. Subject Matter
FlowStart is an app for daily creative tasks. Using it requires a paid subscription (sections 4 and 5).
3. Registration
Registration is required to use the app. You must be at least 16 years old.
4. Scope of Service
4.1 The subscription includes:
- Up to 3 categories at the same time
- All categories and difficulty levels
- The garden with all plants and decorations
- Rerolling up to 3 tasks per calendar month
- 2 streak freezes per calendar month
The app contains no advertising.
4.2 Accounts created before the subscription was introduced can keep using FlowStart in the free scope offered at that time (1 category, beginner level).
5. Subscription, Free Trial and Payment
5.1 The subscription is available as a monthly or yearly plan, each also as a lower-priced education plan for pupils, students and self-learners. You choose the education plan yourself; no proof is required.
5.2 The yearly plan can start with a free trial of 7 days. Whether the trial is offered is decided by the respective store, usually only if your store account has not had a FlowStart subscription before. If you cancel before the trial ends, you pay nothing. Otherwise it automatically converts into the paid yearly plan.
5.3 Payment is processed through the Apple App Store or Google Play Store.
5.4 The subscription renews automatically unless canceled at least 24 hours before expiration.
5.5 Cancellation is done through the subscription settings of the respective app store. You can reach them directly from the app under Profile > Manage subscription.
5.6 The contracting party for the purchase is the respective store (Apple or Google), not us. Payment processing, invoicing and refunds are handled exclusively by the store. Any right of withdrawal and any refund requests are therefore governed by the terms of the respective store and must be raised there:
5.7 When the subscription ends, you can no longer use the tasks until you subscribe again. Your account, your progress and your garden are kept.
6. Usage Rights and Sharing
6.1 With the download, you receive a simple, non-transferable right to use the app for yourself.
6.2 The tasks, texts, drawings and design of the app are protected by copyright.
6.3 Sharing is explicitly welcome. You may show screenshots, individual tasks and anything you create with them, privately and on social media, ideally with a mention of FlowStart. What you create belongs to you.
6.4 It is not allowed to collect and redistribute tasks on a large scale or to use them commercially, for example as your own task collection, app or course.
7. Availability
We strive for high availability but cannot guarantee it. Maintenance work will be announced when possible.
8. Liability
8.1 We are fully liable for intent and gross negligence.
8.2 For slight negligence, we are only liable for breach of essential contractual obligations.
8.3 Liability for data loss is limited to typical recovery costs.
9. Termination
You can delete your account at any time in the app under Profile > Delete account. Without the app installed, you can request deletion at https://flowstart.app/delete-account.html. The subscription must be cancelled separately through the respective store (see 5.5).
10. Changes to Terms
We reserve the right to change these Terms. We will inform you of significant changes via email or in the app.
11. Final Provisions
11.1 German law applies.
11.2 The place of jurisdiction is Dierdorf, Germany, where legally permitted.
11.3 If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
